CAR RENTAL WITH DRIVER AND SERVICE AGREEMENT

The parties to this "Agreement" are Malkadı Turizm Seyahat Tanıtım ve Hediyelik Eşya Sanayi Ticaret Limited Şirketi (hereinafter called Viport Transfer), registered in the Istanbul Trade Registry, whose head office is Bahçelievler Mah, Yaseminli Sok, Zambak Apt, No:2/8 Bahçelievler İstanbul Turkey. ) and the person who purchases the service by providing the necessary information in the online area www.viporttransfer.com (hereinafter referred to as the Buyer).

Viport Transfer and the Buyer will hereinafter be individually referred to as "Party" and together as "Parties".

Information Regarding the Subject and Service:

Viport Transfer accepts and declares to provide the service information given in this agreement ("Car Rental Service with Driver") to the Buyer within the scope of this Agreement and to purchase the Buyer Service for the price specified in the details and to pay the price to Viport Transfer. The parties have agreed upon the following terms and conditions as a result of the mutual declarations and commitments they made with this Agreement:

Car Rental Service with Driver; The parties rent the vehicles with the driver, the detailed information of which is given along with the photographs of the Buyer in the online area www.viporttransfer.com, and "from an address (point) declared by the buyer within the borders of the Republic of Turkey to another address (point)" (hereinafter referred to as transfer). is to be taken away.

Service Fee and payment

The service fee varies depending on the type of service, detailed information of which is provided in the online area www.viporttransfer.com. However, the service fee varies depending on the type of service, that is, the vehicle selection information given in the online area www.viporttransfer.com. The service fee does not change even if a person below the maximum passenger capacity gets into the vehicle. To explain it with an example, in a vehicle with a capacity of (6) six people, excluding the driver, the Buyer pays the same service fee whether he purchases service for (1) one person or (6) six people.

Information regarding the reservation and the type of service selected by the Buyer is sent to the Buyer via SMS to the phone number provided by the Buyer and/or via e-mail to the e-mail address provided by the Buyer. Viport Transfer does not assume any responsibility if the phone number and/or e-mail address provided by the buyer is incorrect and/or not used.

Rights and liabilities of the parties

The Buyer accepts and undertakes that all information provided to Viport Transfer within the scope of this Agreement, including identity, contact and address information, is correct. The parties agree that Viport Transfer will not be responsible for Viport Transfer's failure to fulfill its obligations arising from the Agreement due to incorrect information provided, and that if Viport Transfer suffers a loss due to incorrect information provided, the Buyer will bear all direct and indirect damages of Viport Transfer in cash. They accept and declare that they are responsible for the compensation in full.

The necessary precautions for the security of the information and transactions entered by the buyer in the online area www.viporttransfer.com have been taken within the system infrastructure of Viport Transfer, within the scope of today's technical possibilities, according to the nature of the information and transaction. However, since the information in question is entered from the Buyer's device, it is the Buyer's responsibility to take the necessary precautions, including those related to viruses and similar harmful applications, to ensure that it is protected by the Buyer and cannot be accessed by unauthorized persons.

Payment method: In cash, via wire transfer/EFT or by credit card. The buyer can pay the service fee in cash, money order/EFT or by credit card. If the buyer chooses to pay by credit card, he must enter his credit card information on the IYZICO screen. If the Buyer does not pay the Service fee in full to Viport Transfer, Viport Transfer has the right to unilaterally terminate the Agreement and not provide the Service.

If the Buyer pays by credit card, the Buyer enters his credit card information through IYZİCO and requests and accepts that the service fee will be collected by Viport Transfer. While the Buyer is paying the service fee by credit card, if the bank where the credit card is located asks for any additional fee, Viport Transfer will not have any responsibility for this. The Buyer should contact the bank from which he obtained the credit card, if he wishes.

If the Buyer prefers to pay via wire transfer/EFT, the Buyer is responsible for the bank's EFT transaction fee/service fee for EFT. It cannot be deducted from Viport Transfer's service fee.

When requesting the service subject to this contract, the Buyer is obliged to inform Viport Transfer about the type of vehicle subject to the service, the number of people he wants to travel in the vehicle and the information of these people, the total number of luggage and the size and total weight of the luggage. The buyer cannot request that more passengers and/or luggage be transported than the number of passengers in the vehicles detailed in the service type. Failure by Viport Transfer to accept passengers and/or baggage exceeding the capacity of the service type does not constitute a justified reason for the Buyer to terminate the contract and the Buyer will be obliged to pay the full service fee.

The person and baggage information provided by the Buyer to Viport Transfer during the preparation of this contract cannot be changed later unless accepted by Viport Transfer. Failure to accept the Buyer's change request by Viport Transfer does not constitute a justified termination reason for the Buyer. If the Buyer does not receive service in this case, the Buyer is obliged to pay the service fee. If the Buyer has already paid the service fee, in this case the service fee will not be refunded.

If the Buyer requests a wheelchair among the people he/she requests the service from and requests a wheelchair based on their disability, he/she is obliged to notify this request at least 4 (four) hours before the reservation. If there is a patient among the people from whom he requests the service, the Buyer is obliged to prepare the necessary travel documents and submit them to Viport Transfer, stating that this patient does not have a contagious disease and "there is no harm in traveling and/or traveling". Otherwise, the Buyer will be responsible if Viport Transfer suffers any damage.

The buyer and the people traveling in the vehicle are obliged to act in accordance with the laws of the Republic of Turkey. People traveling in the vehicle are obliged to wear seat belts. Consuming alcohol in the vehicle is prohibited. The buyer and the people traveling in the vehicle cannot carry criminal items in the vehicle, nor can they keep drugs or other items and types of them that are against the laws of the Republic of Turkey under any other name or name in their luggage. If such a suspicious situation is detected by Viport Transfer, Viport Transfer has the right not to provide service and will immediately notify the competent authorities. In this case, Viport Transfer is entitled to the full service fee. If Viport Transfer and/or other passengers in the vehicle suffer additional damage, the Buyer is responsible for all of these damages.

In order to receive the service within the scope of this contract, the buyer must make a reservation at least 2 hours before the transfer time. When the Buyer wishes to receive service on national and general holidays in the Republic of Turkey: Ramadan Feast, Eid al-Adha, 29 October Republic Day and other holidays 15 July, 1 May, 1 January, 23 April, 19 May, 30 August, Since these days are busy and are holidays, reservations must be made at least 24 hours before the transfer time.

If the Buyer wishes to exercise his/her right of withdrawal in this contract, he/she can make this notification in writing and/or via e-mail to reservation@viporttransfer.com, via SMS and/or WhatsApp to Viport Transfer's number +90 544 642 80 60 before the transfer time. It is obliged to deliver it at least 1 hour in advance. The Parties accept and declare that Viport Transfer reserves all claim rights if the Buyer does not exercise its right of withdrawal in accordance with the procedure. If the buyer has exercised his right of withdrawal in a timely manner and in accordance with the procedure, Viport Transfer will refund the service fee if he received the service fee before the right of withdrawal was exercised. Matters regarding returns are regulated in Articles 5 and the following of this agreement. If the buyer backs out and cancels the reservation outside the specified period, the service fee will not be refunded to the buyer.

The Buyer cannot request a change in the transfer route notified during the preparation of this contract. The buyer cannot request to visit addresses other than the transfer addresses he/she declared or to wait at any address. However, Viport Transfer reserves the right to provide service upon the Buyer's request by requesting a separate service fee.

Viport Transfer is obliged to act in accordance with the legislation and take the necessary precautions so that the Buyer can receive a safe service. It is obligatory to have personal accident and seat insurance for the vehicles subject to the service types in this contract, to have the vehicles periodically maintained, and to have a first aid kit in the vehicles.

The personal data provided by the Buyer is processed with his/her express consent in cases where consent is required in accordance with the provisions of the Personal Data Protection Law No. 6698, and without his/her consent in cases of legal obligation and/or for the performance of the service and in cases stipulated in the said Law. The Buyer and the persons on whose behalf the Buyer has made a reservation are obliged to show their identity documents, if requested by Viport Transfer, to show that they have received the service subject to this contract. If the service cannot be provided due to the Buyer not fulfilling this obligation, Viport Transfer is entitled to the entire service fee. The parties accept and declare that in this case, the entire service fee will be paid to Viport Transfer.

The parties accept and declare that Viport Transfer has no liability in case the Buyer's personal belongings are left in the vehicle, forgotten or damaged in any other way. However, if Viport Transfer notices that items have been forgotten in the vehicle, it will notify the Buyer of this situation. The buyer is obliged to request the goods by cargo within 7 business days at the latest, at his own expense, or to personally come to the address notified by Viport Transfer and collect the goods within 7 business days at the latest. After this period, Viport Transfer can no longer be held responsible for storing the goods.

The Buyer or the persons on whose behalf the Buyer has made a reservation may request that a "pet" be transported with them, that is, provided that it is accompanied and in a cage. However, this request must be notified to Viport Transfer at the time of booking the service subject to this contract at the latest. The buyer accepts and declares that the pets comply with all provisions of the legislation, including the health-related provisions. Birds, cats and dogs can be carried as pets; Animals that are prohibited according to the legislation cannot be transported. Cage size can be maximum 23*40*55 cm.

If the Buyer and/or the passengers notified are not ready for the transfer at the time they notified and/or are late, Viport Transfer will contact the Buyer at the phone number provided by the Buyer. If the Recipient cannot be reached at all, Viport Transfer will wait for the Receiver for 15 minutes at the latest. If the buyer shares delay information, Viport Transfer waits for a maximum of 20 minutes. In these cases, Viport Transfer is entitled to the full service fee and does not have any liability since it does not wait any longer.

If Viport Transfer cannot be ready due to force majeure such as traffic accident, road closure by decision of official authorities, flood, natural disaster, Viport Transfer will not have any liability. However, if Viport Transfer cannot be ready to provide the service to the Buyer at the promised time for a justified reason, Viport Transfer will reach the Buyer at the phone number provided by the Buyer and notify the situation. In this case, the Buyer's transfer-related loss will be covered by Viport Transfer, provided that the Buyer documents the material damage, up to a maximum of 400 TL. If Viport Transfer is late, the Buyer waits for Viport Transfer for a maximum of 20 minutes. If Viport Transfer is not ready at the address notified for transfer within this waiting period, the Buyer will not be held liable to pay the service fee. Alternative service is offered to the Buyer, the Buyer is not obliged to accept it. In this case, the Buyer's loss related to the transfer will be covered by Viport Transfer, provided that the Buyer documents the material damage, not exceeding a maximum of 400 (four hundred) TL. The damage compensated in this article is limited to the transfer only and does not include other damages (for example, missed flight tickets, etc.).

In the "Car Rental Service with Chauffeur", the driver has no obligation other than driving the vehicle in accordance with the legislation and delivering it to the required location. The driver cannot be expected to carry luggage, pets and/or leave the vehicle at the destination address and accompany the passenger to the door, etc.

The parties accept and declare that Viport Transfer will not have any liability in case the Buyer and/or passengers and/or their belongings are damaged in any traffic accident and/or other situation during the transfer. The Buyer irrevocably accepts and declares in advance that in such a case, Viport Transfer will not have any liability in accordance with the relevant provisions of the Turkish Code of Obligations.

5. CANCELLATION - REFUND

5.1. The parties accept and declare that if the periods set out in the context of the terms and conditions of this contract have passed, the Buyer cannot cancel the contract and Viport Transfer cannot be held liable to refund the service fee.

5.2. If the buyer wishes to make a change regarding his reservation, he is obliged to notify Viport Transfer of this change request at least 1 hour before the transfer time. Viport Transfer has the right to refuse to provide the service in case of change.

5.3. Viport Transfer, due to both the vehicle and the reasons such as climate, road, traffic accident, road closure and etc., force majeure or unexpected situations; has to cancel the reservation and/or transfer; If there is no fault on the part of Viport Transfer, there will be no obligation to refund the service fee.

5.4. Reservation change request can be sent by the Buyer to Viport Transfer's e-mail address reservation@viporttransfer.com, or it can be sent to Viport Transfer's number +90 544 642 80 60 via call center and/or SMS. When requesting a change, the Buyer submits his reservation code, identification information and request.

5.5. Viport Transfer refunds the service fee as collected by credit card; That is, if the service fee is paid all at once, the refund will be made to the "paid card" in one go. If the service fee is paid in installments, it will be refunded to the "payment card" in installments. Viport Transfer will not be held liable if the refund is delayed due to holidays and/or busy banks. If Viport Transfer has to incur any expenses during the refund process, it will refund the service fee by deducting this money from the service fee. The period for the refund of the service fee varies depending on whether the payment is made through Turkish banks or not. If Viport Transfer has received the service fee via money order/EFT, the refund is made to the same bank account via wire transfer/EFT, provided that the money transfer/EFT transaction fee (bank service fee) is deducted from the service fee in this contract during the refund, Viport Transfer's money order/EFT There is no obligation to pay transaction fees. Viport Transfer will not be held liable if the refund is delayed due to holidays and/or busy banks.

5.6. If Viport Transfer is notified of a suspicious transaction during and/or after the payment is made, it has the right to keep/keep the service fee for as long as necessary for the transaction until the necessary approval is received.

5.7. The Buyer cannot transfer or assign this contract and/or any rights and receivables that have arisen or will arise from this contract to any other person.

5.8. Turkish Law applies to this Agreement. The parties, for any dispute arising from the interpretation and implementation of the contract between the parties to this contract, T.R. Bakırköy Courts and Enforcement Offices have accepted and declared that they are competent.
